These terms apply to everyone who visits our websites, reads our emails, or receives our text messages. You do not sign them. Using the site means you accept them.
Clients sign a separate document, the Client Services Agreement and Informed Consent, before work begins.
These terms are between you and Crescent Clearing, LLC, a Florida limited liability company doing business as Crescent Holistic Health ("Crescent Holistic Health," "we," "us," or "our"), located at 11161 E State Rd 70, Unit 110-944, Lakewood Ranch, FL 34202.
They cover crescentholistic.com, ltf.crescentholistic.com, any other site or landing page we operate, our email and text messaging programs, and any content we publish.
By using our websites, submitting a form, subscribing to our emails, or agreeing to receive text messages, you accept these terms. If you do not accept them, do not use the sites.
You must be at least 18 to use our websites or to purchase services. A minor may become a client only through a parent or legal guardian, who signs the Client Services Agreement and holds the account.
Everything on our websites — articles, assessments, quizzes, guides, newsletters, videos, and social posts — is educational. It is general information about how bodies work. It is not medical advice, it is not a diagnosis, and it is not a treatment plan for you.
Reading this site does not create a practitioner-client relationship. That relationship begins only when you have purchased a service and signed the Client Services Agreement and Informed Consent.
Cynthia Fluck is a Certified Applied Functional Medicine Practitioner (AFMP), a Certified Emotion Code Practitioner (CECP), and a Certified Body Code Practitioner (CBCP). She is not a licensed medical physician, naturopathic doctor, registered dietitian, nurse, psychologist, or licensed mental health professional.
We do not diagnose, treat, cure, or prevent any disease, disorder, or medical condition. Nothing we publish or say is a substitute for care from a licensed provider.
Always consult a qualified medical provider before changing your diet, starting a supplement, or altering any prescribed treatment. Never disregard professional medical advice or delay seeking it because of something you read here.
If you think you may have a medical emergency, call 911 or your local emergency number immediately.
Statements about dietary supplements have not been evaluated by the Food and Drug Administration. Supplements are not intended to diagnose, treat, cure, or prevent any disease.
Functional laboratory panels we discuss or facilitate, including the DUTCH test, are wellness and functional assessments. They are used educationally to understand patterns in your body. They are not diagnostic tests, they do not replace clinical laboratory work ordered by your physician, and our interpretation of them is educational rather than a medical opinion.
Tests are ordered through third-party platforms and processed by independent laboratories. Those companies set their own terms, prices, shipping rules, and geographic restrictions, and we do not control them. Some tests cannot be shipped to some locations.
Health outcomes vary from person to person, and nothing on this site is a promise of any particular result. What worked for one woman may not work for you, and what worked for Cynthia may not work for you.
Testimonials are real and are published with permission. Where we tell a client story to teach something, it is either published with that client's written permission, or it is a composite blended from several people so that no individual is identifiable. Where a story is a composite, we say so in the story.
All content on our websites and in our materials — writing, images, assessments, protocols, frameworks, course material, and the Emergence Method™ — is owned by Crescent Clearing, LLC or used under license, and is protected by copyright and trademark law.
You may read it, print a copy for yourself, and share a link. You may not copy, republish, sell, or use it to build a competing product or program, and you may not use it to train an artificial intelligence model, without our written permission.
Do not use our sites to break the law, to harass anyone, to upload malicious code, to scrape or harvest data, to impersonate anyone, or to attempt to gain access to any part of our systems you are not entitled to reach.
Our sites link to other services, including laboratories, supplement dispensaries, scheduling tools, and articles. We do not control them and we are not responsible for their content, their products, or their privacy practices. Your dealings with them are between you and them.
By giving us your email address or mobile number you consent to receive communications from us electronically, and you agree that electronic communications satisfy any legal requirement that a communication be in writing.
By providing your mobile number and checking the consent box, you agree to receive text messages from Crescent Holistic Health at the number provided, including messages sent by an automatic telephone dialing system.
Consent is not a condition of purchase. You can become a client, buy anything we sell, and receive everything you have paid for without ever agreeing to a text message.
We ask for two separate consents, and you may give either, both, or neither:
Message frequency varies, and is generally no more than a handful of messages per month.
Message and data rates may apply. These are charged by your mobile carrier, not by us.
Reply STOP at any time to opt out. You will receive one confirmation message and then no further messages. Reply HELP for help, or email cynthia@crescentholistic.com, or call 941-677-8098.
Carriers are not liable for delayed or undelivered messages.
We do not send symptoms, diagnoses, laboratory results, or other health details by text. If we need to reach you about a result, the message will say a result is ready and point you to a private channel.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
Marketing emails include an unsubscribe link and our physical mailing address. Unsubscribing from marketing email does not stop transactional messages such as appointment confirmations, order notices, and messages about work already underway.
Our Privacy Policy and our Consumer Health Data Privacy Policy explain what we collect and what we do with it. Both are incorporated into these terms.
Our websites and content are provided "as is" and "as available." To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the sites will be uninterrupted, error-free, or free of harmful components.
To the fullest extent permitted by law, Crescent Clearing, LLC, Crescent Holistic Health, and Cynthia Fluck will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising from your use of our sites, our content, or our services.
Our total liability for any claim arising out of or relating to these terms or our services will not exceed the greater of the amount you paid us in the twelve months before the claim arose, or one hundred United States dollars.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so parts of this section may not apply to you.
You agree to indemnify and hold harmless Crescent Clearing, LLC, Crescent Holistic Health, and Cynthia Fluck from any claim, loss, liability, or expense, including reasonable legal fees, arising from your breach of these terms, your misuse of the sites, or your violation of any law or the rights of a third party.
These terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Any dispute that is not resolved informally will be brought exclusively in the state or federal courts located in Manatee County, Florida, and you consent to the jurisdiction of those courts.
If something goes wrong, email cynthia@crescentholistic.com first and describe the problem. We will respond within fourteen days and try to resolve it directly. Most things can be sorted out this way, and we would rather hear it from you than from a lawyer.
If we cannot resolve it within sixty days, either of us may pursue the matter in the courts named in Section 17.
We may update these terms. If we do, we will change the "Last updated" date at the top, and if the change is material we will say so on the site or by email. Continuing to use the sites after a change means you accept the updated terms.
If any part of these terms is found unenforceable, the rest stays in force. Our failure to enforce a provision is not a waiver of it. You may not assign these terms; we may assign them in connection with a sale or transfer of the practice. These terms, together with the two privacy policies and any signed Client Services Agreement, are the entire agreement between us.
Clients also sign a separate Client Services Agreement and Informed Consent before work begins. Where that signed agreement conflicts with these terms, the signed agreement controls for that client.
